Marshal denied waiver to live in Munds Park
Council votes 5-2 to follow Town Code

CAMP VERDE - With close to 30 Camp Verde residents looking on, listening up and speaking out, Town Council voted 5-2 Wednesday to reject CVMO Marshal Nancy Gardner's request to live in Munds Park.

Gardner had requested the Town waive the residency requirement, pursuant to 3-2-4.A of the Town Code.

Mayor Charlie German, and council members Bruce George, Jackie Baker, Jessie Jones and Carol German voted against the waiver, with council members Brad Gordon and Robin Whatley voting to allow Gardner to live in Munds Park, which is located more than 30 miles from Camp Verde, in Coconino County.

Though Gardner had just moved from a rental just outside of Camp Verde to a recently purchased vacation home in Munds Park, she will be expected to return to Camp Verde.

At this time, the Council has not given direction to Town Manager Russ Martin as to when Gardner must re-establish residency in Camp Verde. However, Martin said that Gardner would immediately begin to look for a place to live in town.

"As with any code enforcement, we don't take a harsh approach," Martin said. "We give people a reasonable amount of time to be compliant. I'm going to take the same approach with her as I would with anyone else. [Gardner] will find something as soon as possible. She and I will work to make this happen as soon as possible. But there are logistics."

In a recent Bugle poll, 75 percent of nearly 40 responders did not believe Gardner should be given the waiver.

Camp Verde resident Cheri Wischmeyer told the Council she was "vehemently opposed" to Gardner's request.

"It is my opinion that the intent [of the code] was not to allow [Marshal Gardner] the right to permanently reside outside of the town," Wischmeyer said. "It was never meant ... for a request to reside 30 to 50 miles from the [town] limits. She needs to be here and available to the needs of the community in an emergency, 24/7."

Camp Verde resident Jim Meredith also said Gardner needs to be available to the community around the clock.

"Our Marshal should have a vested interest in our community," Meredith said. " She should want to live here with us, be here with us, to patrol us."

CVMO Assistant to the Chief/Civilian Investigator Darby Martin told Council - and the general public - that she was upset with the comments against Gardner.

"Regardless of where she's living, [Marshal Gardner has] been more dedicated to the community than any other marshal in the 16 years I've been here," Martin said. "There's not an agency in the Verde Valley that can play in the same sandbox as the CVMO."

I think you missed the point. The purpose of having LEO living locally is so that they feel the need to be a part of the community. I imagine it was quite uncomfortable for you to run into someone you had treated unfairly or harshly. The militarization of our police departments has the unintended consequences of making LEOs feel like it's "Us against Them".

Maybe if you have to see your neighbors and their kids in public you won't be so quick to mistreat them and talk to them like they're criminals instead of citizens.

Why can't we all see the difference in our Police Department? I happen to greatly appreciate the effort and hard work that Marshal Gardner has done for this town. Since her arrival this department has a reason to hold it's head high and be proud something that I have not seen in my life. I also wish that my brother would have had the chance to work for a Marshal of her caliber when he was here at the Marshal's Office.
I would greatly hate to see her go somewhere else and leave us to backslide into the hands of a failure again.
I truly think as paying citizen we should know the truth and real reason why our great Marshal is not wanting to reside here in our town? Is there just cause to grant this or to not grant this? Along with that I am concerned that her presence needed in a emergency and not being available due to being that far away may be critical to our safety or the safety of our officers.
I think before everyone flies off on a rant that getting all the facts and truth in the matter would be better, so far I have not found anywhere why this should be a justified move. At the same time I hope we do not loose Marshal Gardner due to this issue, she has been a great asset to our community.

I agree with the Camp Verde Citizen article on Gordon and Whatley, they need to go now, not later. I hope we all remember this when their term is up. Rules apply to everyone, but I guess some don't think that way. I'm glad those five members voted no. I hope Jim finds out the real deal with Darby to, and let all of us know. There is something key there, and her day will come. Council wake up, that's all I have to say. Don't look like the Town Manager wont do much but I hope the five member's do. Sheri Wischmeyer you need to get to the bottom of this deal with Darby being the Marshals pet at cvmo. The Town Marshal needs to go. Sue

It should be well remembered when you vote in the next election that Gordon and Whatley evidently are in favor of selectve enforcement of the rules in Camp Verde. And as far as Town Manager Martin stating that code violations are not addressed with a 'Harsh Approach" he is either be on drugs or drunk! Violations are, in fact, handled with a "Harsh Approach" and this should be handled in the same manner! Maybe a daily fine until the Marshal is in compliance is in order. Maybe Martin should incur the same needed fate as Gordon and Whately and look for new employment if he is not of the opinion that rules are meant to be followed and apply to all!

Well I can understand the reasonable objection to the Marshal living in Munds Park. That may indeed be a bit too far away. Especially when the snow flies.
I can understand a reasonable person holding that position.

On the other hand, considering the last two pieces of work we had for Town Marshal (remember those) if the current Lady Marshal does not reside EXACTLY within the boundaries of Camp Verde, I am not going to get the vapors over that.

The little County pocket out Salt Mine road, or Rim Rock or Lake Montezuma, or even Cottonwood, have a little common sense. That is no big deal. Is it now?

Glad to find that the mayor and council followed the codes of our town. I read the town managers reply to the ruling and I am uncertain how the town will police this ruling. Mr. Martins response to the ruling was very open as to when our marshal needs to be living back in camp verde. I hope that this is not another "slick willie" move on our town managers part. I personally will be reviewing the state arizona statutes on this matter and I hope others will stay on top of this issue.

I have to agree, how come Darby was the only one there that night to support the Marshal? Darby sure opened up a can of worms, I would like to know if she was on duty when she wrote her little nasty blogs, tax payer dollars going to the waste, plus I have to agree with the others, there is something there about Darby must be the teachers per, sorry Marshal's pet. Hope someone finds out why and let all of us know. I hope the council and town manager see this. Susie. It will all come out one day?????

Kind of ironic that the majority of officers I know oppose the idea but Ms. Martin is sticking up for the Marshal like she can't battle herself. Her words certainly speak volumes about how she is treated there. Can anyone say teachers pet!

Okay Darby, I guess you win, I'm sure there is some reason why you are defending her that I and the public does not know about or the council, but I could only wish to know. I'm sure you are well taken care of then by the Marshal, but if she wants to be the Town marshal then live here, being the Asst Chief, looks like you are good to go. The Council voted and that's it. I will dig deeper and find out why you are so defensive and on the attack, I hope we find the solution to it and post it or speak up to the Council about how she is taking care of you. Keep shouting off at the mouth, your time will come with the Council I hope when we all find out why your so special at cvmo. Jim...

In no way shape or form was I comparing the two towns! I just donít see how Mrs. Wischmeyer could be so vehemently opposed to Mrs. Gardner living outside of the town limited when Mr. Wischmeyer did the exact same thing when he worked in Jerome. Was it not a concern to Mrs. Wischmeyer then because it was Jeromesí tax payersí money or is it that she feels Jerome citizens don's deserve the same protection she is requesting from Mr. Gardner?

And I do agree with you Sir, this is not the place for Jabs, however Mrs. Gardner has unfairly suffered numerous jabs from uniformed community members since this has hit the papers. Every member of this community deserves respect, including Mrs. Gardner!

Let the Chief live where she wants to. I was a Police Officer in a small town and also lived there, I will tell you that it was not all that fun. You could not live a normal life because most people knew you and when you were out and about off duty you would run into people who you had prior dealings with or had previously arrested. we all need a break from our work, especially a Police Officer. I cannot blame her one bit for wanting to live somewhere else, besides it is only 30 minutes away, give her a break!

Ms. Martin, I have not seen Mr. Wishmeyer in quite awhile but last I knew he was retired from law enforcement. Why are you comparing Jerome to Camp Verde? Do you think Jerome is better than Camp Verde?

I was at the meeting and take great offense to your tone used in the meeting. I will not go on further as this is not the place for such jabs.

I don't feel that any person who resides out side of the town the they work for should be allowed to use company vehicles, or tax payer money to commute back and forth, my opinion did change after reflection of last night's meeting, I could care less if Marshal Gardner lives in Munds Park, I did believe at the beginning that she should live here, but renting is a complete loss of money, I didn't not really care for the bashing that was given to the residents concerns was called for.
